LIVING COL

TERMS AND CONDITIONS FOR TRAVEL SERVICES

1. COMPANY INFORMATION

LIVING COL S.A.S., Tax Identification Number (NIT) 900.469.543-6, National Tourism Registry (RNT) No. 25978, based in Ibagué, Colombia, operates as a travel agency under applicable Colombian law.

2. SCOPE OF THESE TERMS

These Terms and Conditions apply to the booking, purchase and provision of travel packages, tours and other travel services sold or arranged by LIVING COL.

The specific conditions included in your quotation, booking confirmation, travel vouchers, tickets or other relevant documents also form part of your booking agreement.

3. INCLUDED AND EXCLUDED SERVICES

LIVING COL will clearly inform you which services are included in your travel package and which are not.

Please review your quotation and booking confirmation carefully and let us know as soon as possible if you notice any incorrect or missing information.

4. THIRD-PARTY SERVICE PROVIDERS

To arrange your trip, LIVING COL may work with third-party providers such as airlines, hotels, local tour operators, transport companies, guides, national parks, attractions and other travel service providers.

Working with third parties does not remove LIVING COL's legal responsibilities as a travel agency.

Each provider is responsible for the services and obligations assigned to them under applicable law and their contractual agreements.

5. FLIGHTS AND AIR TRANSPORT

Flights are subject to the airline's conditions of carriage, the fare rules of your ticket and applicable aviation regulations.

Under Colombian regulations governing travel agencies, LIVING COL is not responsible for airline operations, except where the law provides otherwise, including certain charter flights.

Flight delays, cancellations, schedule changes, flights returning to their departure airport, diversions and other operational decisions are governed by applicable aviation regulations.

We will inform you of relevant ticket restrictions, including conditions for changes, ticket transfers, cancellations and refunds.

If you booked your flight through LIVING COL, we will provide reasonable assistance in contacting the airline and exploring the available options. However, this assistance does not mean that LIVING COL must cover costs that are legally the airline's responsibility.

6. FORCE MAJEURE AND EVENTS BEYOND OUR CONTROL

Unless applicable law or your booking agreement states otherwise, LIVING COL and its service partners are not responsible for events beyond their control when those events legally qualify as force majeure, unforeseen events or other circumstances that exclude liability.

Depending on the circumstances, these may include:

Whether this provision applies will depend on the specific nature, cause and circumstances of the event.

7. CHANGES TO YOUR ITINERARY

Sometimes changes to your travel plans may be necessary because of severe weather, safety concerns, force majeure, unforeseen events, government decisions, operational restrictions or other justified circumstances.

In such cases, LIVING COL may make changes permitted by applicable law to help ensure that your trip can continue as smoothly as possible.

These changes may affect:

If we need to replace a hotel or another service, we will make reasonable efforts to offer an alternative of a similar or higher standard, subject to availability and practical circumstances.

8. UNUSED TRAVEL SERVICES

If your trip is cancelled before departure or interrupted after it has started for reasons that are not attributable to LIVING COL, we will review which unused services may be eligible for a refund.

Refund amounts may be reduced by applicable deductions or cancellation fees previously established by the service providers, as permitted by law.

Please note that being unable to use a service does not automatically mean that its full cost can be refunded.

9. REFUNDS

Refund requests will be reviewed based on:

LIVING COL will process refunds that are legally due within the time limits established by applicable law and the relevant providers.

Nothing in these Terms and Conditions limits your legal right to receive refunds to which you are entitled.

10. UNEXPECTED ADDITIONAL COSTS DURING YOUR TRIP

Sometimes unexpected events beyond LIVING COL's control may make additional services necessary. These may include extra hotel nights, meals, transfers, new airline tickets or fare differences that were not included in your original booking.

Who is responsible for these costs will depend on the cause of the event, the obligations of the provider involved, applicable regulations, your booking conditions and any available travel insurance or assistance coverage.

Unexpected circumstances do not automatically mean that LIVING COL must cover these additional expenses.

In certain situations, LIVING COL may voluntarily cover specific costs to help you continue your trip.

Unless otherwise required by law, such exceptional assistance does not, by itself, mean that LIVING COL accepts legal responsibility for the event or is automatically required to cover costs arising from similar situations in the future.

11. SUPPLIER CANCELLATION FEES AND PENALTIES

Your booking may be subject to cancellation fees, deductions, fare differences or other conditions previously established by the relevant service providers.

LIVING COL will inform you of the relevant conditions applying to your booking, in accordance with its legal obligations.

12. CANCELLATIONS REQUESTED BY THE TRAVELLER

If you choose to cancel your trip, the cancellation will be subject to the specific conditions provided when you booked, the relevant suppliers' policies and applicable Colombian law.

13. ASSISTANCE DURING YOUR TRIP

If something unexpected happens during your trip, LIVING COL will provide guidance and take reasonable steps to assist you with the service providers involved.

Providing assistance does not automatically mean that LIVING COL must pay costs that are legally or contractually the responsibility of another provider.

We recommend purchasing travel insurance or travel assistance coverage suitable for your destination and the type of trip you are taking.

14. TRAVEL DOCUMENTS

LIVING COL will inform you about known travel documentation requirements relevant to your trip.

You are responsible for ensuring that you have all necessary documents, including valid identification, passports, visas, permits, authorisations for minors, immigration documents, health certificates and any other documents required for travel.

15. INFORMATION PROVIDED BY THE TRAVELLER

You must provide accurate and complete information when making your booking.

Please inform LIVING COL as soon as possible of any circumstances that may affect the proper organisation or delivery of your travel services.

17. PROTECTION OF CONSUMER RIGHTS

These Terms and Conditions are governed by applicable Colombian law.

Nothing in these terms is intended to remove LIVING COL's legal obligations, limit consumer rights that cannot legally be waived or transfer responsibilities to the traveller that legally belong to LIVING COL.

If any provision conflicts with mandatory consumer protection laws, the applicable legal provisions will take priority.
